Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BooDraft platform at boodraft.com ("Service"), operated by BooDraft ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old and capable of forming a legally binding agreement to use BooDraft. By using the Service, you represent that you meet these requirements.

2. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating an account.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at support@boodraft.com if you suspect unauthorized access.

3. Subscriptions and Billing

Plans

BooDraft offers the following subscription plans:

  • Starter: $29/month -- 10 articles
  • Growth: $49/month -- 30 articles
  • Pro: $79/month -- 100 articles
  • Agency: $149/month -- 300 articles

Billing

  • Subscriptions are billed monthly in advance via Stripe.
  • Article quotas reset at the beginning of each billing cycle. Unused articles do not roll over.
  • You may upgrade or downgrade your plan at any time. Changes take effect at the start of your next billing cycle.

Cancellation

  • You may cancel your subscription at any time from your account settings.
  • Upon cancellation, you retain access to the Service until the end of your current billing period.
  • After cancellation, your account transitions to a read-only state. You may still access and export your existing content.

4. Acceptable Use

You agree not to use BooDraft to:

  • Generate content that is illegal, defamatory, harassing, threatening, or discriminatory.
  • Create spam, misleading content, or content designed to manipulate search engine rankings through deceptive practices.
  • Produce content that infringes on the intellectual property rights of others.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Attempt to reverse-engineer, decompile, or extract source code from the platform.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use automated scripts, bots, or scrapers to access the Service outside of the provided interface and API.
  • Resell or redistribute generated content as a white-label service without a written agreement.

We reserve the right to suspend or terminate accounts that violate these terms.

5. AI-Generated Content

Ownership

You own the articles and content generated through BooDraft. We do not claim intellectual property rights over your generated content.

Your Responsibilities

  • You are solely responsible for reviewing, editing, and verifying all AI-generated content before publishing.
  • AI-generated content may contain inaccuracies, outdated information, or unintended similarities to existing works. You must review all content for accuracy and originality.
  • You are responsible for ensuring that published content complies with applicable laws and regulations, including copyright, defamation, and advertising standards.
  • BooDraft is a tool to assist content creation. We do not guarantee that generated content will rank on search engines or achieve any specific outcome.

6. Community Research Features

BooDraft analyzes publicly available discussions from platforms including Reddit, Quora, and niche forums to inform article generation.

  • You are responsible for compliance with the terms of service of Reddit, Quora, and any other platforms whose community data informs your generated content.
  • BooDraft does not reproduce or republish community content verbatim. Community data is used solely as research input for AI-generated drafts.
  • You acknowledge that community research is based on publicly available data and that BooDraft does not guarantee the accuracy, completeness, or currency of community insights.

7. Google Search Console Integration

  • Connecting your Google Search Console account is optional and requires your explicit OAuth consent.
  • We access search performance data solely to provide ranking monitoring and content recommendations within the Service.
  • You may disconnect your Google Search Console at any time from your account settings.

8. Intellectual Property

  • The BooDraft platform, including its design, code, features, and documentation, is our intellectual property.
  • You may not copy, modify, or distribute any part of the platform without our written consent.
  • You retain ownership of all content you create using the Service, subject to the responsibilities outlined in Section 5.

9. Limitation of Liability

To the maximum extent permitted by law:

  • BooDraft is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
  • Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
  • We are not liable for any consequences arising from your use, publication, or distribution of AI-generated content.

10. Indemnification

You agree to indemnify and hold BooDraft harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service.
  • Content you generate, publish, or distribute using the Service.
  • Your violation of these Terms or any applicable law.

11. Termination

  • We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice.
  • Upon termination, your right to use the Service ceases immediately.
  • You may export your content before termination. After termination, we may delete your data in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
